Provision of information to the data subject in the collection and processing of his or her personal data and information on rights

The seller is the operator of personal data (hereinafter referred to as "Operator“) according to law no. 18/2018 Z.z. on the protection of personal data and on the amendment of certain laws as amended (hereinafter referred to as "OU Protection Act“). In connection with the processing of the Buyer's personal data (hereinafter referred to as "The person concerned“) The Operator provides the Affected Person in accordance with § 19 Of the OU Protection Act the following information:

• Purpose of the processing of personal data of the Data subject

The purpose of processing the personal data of the Affected Person is the conclusion and performance of the Agreement.

• Legal basis for the processing of personal data of the Data subject

The processing of personal data of the Data subject is necessary for the performance of the Contract.

• Retention period of the data subject

The Operator will keep the personal data of the Affected Person for a period of 5 (five) years from the date of termination of the contractual relationship established by the Treaty.

• Cross - border transfer of personal data of the Data subject

The Operator does not intend the cross-border transfer of the Data subject's data to a third country (t.j. state, which is not a Member State of the European Union or a Contracting Party to the Agreement on the European Economic Area) or an international organization.

• Provision of personal data of the Data subject to the beneficiaries / categories of beneficiaries

The personal data of the data subject may be disclosed to the accounting officer, auditor, tax, legal or other adviser, and subjects, which gives the law the right to make this data available. To the extent necessary, the personal data of the Data subject may be made available to other persons in order to fulfill the purpose of personal data processing, such as. intermediaries, sales representative, postal courier, etc..

• Automated individual decision-making, including profiling

Because of that, that the Operator does not issue decisions, which would be based on the automated processing of the data subject's personal data, including profiling, and which would have legal effects, which affect it or have a similar significant effect on it, the Provider is not subject to the provisions of § 28 Of the OU Protection Act and the obligations arising therefrom.

The Operator shall inform the Affected Person, that the provision of personal data by the Data subject is necessary for the performance of the Contract, therefore, it is a contractual requirement.

• Information on the rights of the data subject
• The right to gain access to the personal data of the Data subject

The affected person has the right to obtain a confirmation from the Operator, whether personal data are processed, concerning it and has the right to gain access to data and information pursuant to § 21 Of the OU Protection Act.

• The right to correct the personal data of the Data subject

The person concerned has a right to do so, that the Operator corrects incorrect personal data of the Affected Person without undue delay and completes incomplete personal data of the Affected Person.

• Right to delete personal data of the Data subject

The person concerned has a right to do so, that the Operator deletes its personal data without undue delay, if the Affected Person has exercised the right to delete them and there is one of the reasons under § 23 ods. 2 Of the OU Protection Act.

• The right to restrict the processing of personal data of the Data subject

The person concerned has a right to do so, that the Operator restricts the processing of personal data, if there is any of the reasons according to § 24 paragraph 1 of the OU Protection Act. If the processing of personal data has been restricted by the Data subject by the applicable law, in addition to storage, the Operator may process personal data only with the consent of the Affected Person or for the purpose of asserting a legal claim, for the protection of persons or for reasons of public interest.

• The right to the transfer of personal data of the Data subject

The data subject has the right to obtain personal data, which concern it and which it has provided to the Operator, in structured, in a commonly used and machine-readable format and has the right to transfer this personal data to another operator, if technically possible and if (i) Personal data are processed in accordance with § 13 ods. 1 letter. aND), § 16 ods. 2 letter. aND) or § 13 ods. 1 letter. b) Of the OU Protection Act a (ii) the processing of personal data is carried out by automated means.

• The right to object to the processing of personal data of the Data subject

The data subject has the right to object to the processing of personal data, which concern her, (i) for a reason relating to its specific situation carried out in accordance with § 13 ods. 1 letter. e) or letter. f) OU Protection Act, including profiling based on these provisions, and (ii) for the purpose of direct marketing, including profiling in scope, in which it relates to direct marketing.

• The right to file a motion to initiate proceedings on personal data protection pursuant to § 100 Of the OU Protection Act.

The data subject has the right to file a motion to initiate proceedings on personal data protection before the Office for Personal Data Protection under the conditions stipulated by the OU Protection Act..

• Notification obligation in connection with the repair, deleting or restricting the processing of personal data

In case, if a repair has taken place, deletion or restriction of the processing of personal data of the Affected Person at the Operator (no matter how, whether at the request of the Affected Person or from the Operator's own activities), The operator of such a repair, the deletion or restriction of the processing of personal data shall be notified to each recipient, unless this proves impossible or requires a disproportionate effort. The Operator shall inform the Affected Person about the recipients only, if the Person concerned so requests.
